1. Definitions 

    1. In these Terms, the following terms have the following meanings: 

      1. “HEIREST”, “we”, “us”, “our” means HEIREST Limited.

      2. “Terms” means these General Terms and Conditions. 

      3. “You” and “your” means the person using our website and purchasing products from us. 

  2. About these Terms 

    1. These Terms apply to all orders for and purchases of products from the HEIREST online store and website. 

    2. By accessing and using our website and/or placing an order for any product(s), you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our website or place an order for any product(s). 

    3. These Terms supersede and exclude all prior or subsequent discussions, representations, terms and/or conditions, and all written or oral agreements.  Nothing in this clause 2.3 limits or excludes any rights you have under applicable consumer laws.  

    4. From time to time, we may change or update these Terms by posting an updated version on our website. Your continued use of our website after any such change or update constitutes acceptance by you of that change or update. The amended Terms shall apply to all orders for products placed with us after such notice. 

  3. Orders 

    1. To place an order for products on our website, you must: 

      1. design, customise, and/or select the product(s) you wish to purchase; 

      2. provide us with all information requested at the time of purchase, including your contact details, delivery address, and payment information; 

      3. make payment for the product(s) in accordance with these Terms; and 

      4. submit your order at the website checkout. 

    2. Your order is an offer from you to us to buy the product(s) in your basket. Our acceptance of your order will take place when we email you with order confirmation. We will assign an order number to your order and tell you what it is when we accept your order in the order confirmation email. 

    3. In the unlikely event that we are unable to accept or fulfill your order, we will inform you of this in writing as soon as possible after your order is placed.  

    4. We will utilise reasonable efforts to maintain acceptable performance of our website so that you can browse and purchase products. However, we do not guarantee that your access to our website will be uninterrupted, or the integrity of content featured on our website or other information stored or transmitted via our website. 

  4. Products 

    1. We make every effort to display as accurately as possible the colours, features, specifications, and details of the products available on our website. 

    2. However, we do not guarantee that the colours, features, specifications, and details of the products will be accurate, complete, reliable, current, or free of other errors, and your electronic display may not accurately reflect the actual colours and details of our products.  You must make your own assessment of the suitability and appropriateness of the products on our website, including all details and descriptions of products. 

    3. We offer a bespoke service whereby you can commission us to design products which may feature any type of metal(s) or stone(s). To request a bespoke design, please complete and submit our bespoke service form, which you can locate here.

    4. All products are subject to availability, and we cannot guarantee that items will be in stock, materials can be sourced by us, or that we will be able to fulfil your order. We reserve the right to discontinue any products at any time for any reason. Prices for all products are subject to change.

    5. For bespoke designs, you may provide us with photographs, designs, images, or other reference materials to assist us in understanding your preferences and design requirements. Reference images will be used for guidance only. 

    6. Unless you are the owner of the relevant design, we do not reproduce, copy, or replicate reference materials, and make no representation that the final product will be similar to any reference materials. 

  5. Delivery 

    1. We ship our products worldwide and we will arrange for delivery after we have received payment for product(s) in full. 

    2. Delivery timeframes are estimates at the time of ordering and may change. If you have placed an order, please refer to your order confirmation email for delivery timeframes and your order tracking link. 

    3. If delivery of any products to you is delayed by an event outside our control, we will let you know as soon as possible. In the unlikely event that you do not receive your order after the stated delivery timeframe, please contact us on support@heirest.com and provide your name, order confirmation number and details of the product(s) you have ordered. 

    4. Risk and title in a product pass to you on delivery of the relevant product. 

  6. Accounts 

    1. When browsing our website and purchasing products, you have the option of creating an account with us, or proceeding as a guest. If you choose to create an account, you agree to provide accurate, current, and complete information and keep your account details up to date. 

    2. Any personal information that you provide to create an account will be collected and handled in accordance with our privacy policy, which you can access here.

    3. You are responsible for maintaining the confidentiality of your account credentials, including your username and password. You agree to accept responsibility for all activities conducted under your account. 

    4. We reserve the right to suspend, restrict, or terminate your account if we reasonably believe that: 

      1. you have breached these Terms; 

      2. your account has been used fraudulently, or in a manner that may harm us or other users of our website; 

      3. you are misusing our website, including by attempting to reverse engineer, alter, modify, adapt, dissemble, or decompile any aspect of our website and the content featured on our website; 

      4. you are using our website in a manner that is unlawful or materially harms our business or brand, including by incorporating our products into another product or business without our prior written permission or using our products for any commercial purpose, including for resale; 

      5. you are attempting to exploit, sell, or generate profit from our website or any of our products; and

      6. it is otherwise necessary to protect our business interests. 

  7. Warranties 

    1. These warranties are provided in addition to your rights under applicable consumer laws and do not limit those rights.

    2. Lifetime Manufacturing Warranty: 

      1. Our products are backed by a lifetime manufacturing warranty against faults in materials and workmanship. If your product has a manufacturing fault, please email us at support@heirest.com with your order details and a photo of the piece. We will then work with you, identify the problem, and if we deem it necessary for remedy, will arrange for your product to be returned for inspection. 

      2. In the event there is a manufacturing fault, we will inspect the returned product(s), and repair or replace the item(s) at our discretion, for as long as you remain the owner of the piece. 

      3. Where a repair or replacement is covered under our Lifetime Manufacturing Warranty, we will cover the shipping costs associated with returning the faulty item(s) and delivering the repaired or replacement item(s) back to you. 

      4. This warranty does not cover items that have been damaged due to inappropriate use or mishandling, or items that have been repaired, altered, engraved, customised or resized by any other party other than us. 

    3. Stone Security Warranty: 

      1. If a stone becomes loose as a result of a setting issue within twelve (12) months of the delivery date, we may, at our discretion, replace and reset the stone at no cost to you. 

      2. For claims accepted under our Stone Security Warranty, we will cover the shipping costs associated with returning the item(s) to us, and delivering the repaired, reset, or replacement item(s) back to you. 

      3. This warranty does not apply where the loose or missing stone results from accidental damage, impact, excessive wear, improper care, alterations, or repairs undertaken by any other party other than us. 

    4. Resize Warranty: 

      1. Each ring is individually crafted to the size specified at the time of order. If your ring requires resizing after delivery, we offer one complimentary re-size within sixty (60) days of the delivery date of the item. 

      2. For claims accepted under our Resize Warranty, we will cover the shipping costs associated with returning the item(s) to us and delivering the resized item(s) back to you. 

      3. Additional resizes or resize requests made after the sixty (60) day period may incur a fee, which will be decided at our sole discretion. 

    5. General Warranty Information: 

      1. Please note that none of our warranties cover theft, loss, accidental damage, or wear. For any general maintenance, we are happy to support in facilitating this with our industry contacts, but this will be at your own expense.  

      2. If you are not sure which applies to your piece, please email us at support@heirest.com with as many images and details as possible. Our team will work with you to ensure you are put in the best possible position to ensure you can continue to wear your HEIREST piece with pride. 

  8. Refunds 

    1. Subject to your rights under applicable consumer laws, refunds are not available if you change your mind after an order is placed because each piece is made to order. We also do not offer exchanges in the event that you change your mind. 

    2. However, if your item is faulty, not as described, or does not meet any other guarantees under applicable consumer laws, it may be covered under our above-mentioned warranties, or through any other remedy provided under applicable consumer laws.  

    3. If you have any issues with your product(s), please email support@heirest.com with your order details and photo(s) of the piece. 

  9. Pricing and payment 

    1. Unless otherwise stated, prices for products are: 

      1. displayed in the currency applicable to your location at the time you access our website;

      2. before checkout, exclusive of any applicable sales taxes, duties, tariffs, import charges, or other governmental fees, which are calculated and added at checkout; and 

      3. inclusive of freight and insurance to your nominated address. 

    2. You agree to pay in full the total amount displayed at checkout at the time you place your order and you authorise us to charge your chosen payment method for that amount. 

    3. Despite clause 3.2, if we discover a genuine and obvious error (acting reasonably) in the price or description of a product after we have accepted your order, we may, acting reasonably, cancel the order by written notice to you.  Where this occurs after payment has been taken, we will promptly refund the full amount paid.  If the error is not obvious, we will honour the order at the stated price, unless otherwise agreed with you.

    4. We accept the following forms of payment: Visa, Mastercard, PayPal, Google Pay, AfterPay, Apple Pay, and other payment methods as we may determine from time to time. 

    5. When an item is charged to a credit card you may be charged fees determined by your bank/payment provider. We are not responsible for these charges, as they are imposed by your bank/payment provider.

    6. You agree to provide accurate, current, and complete purchase information for all purchases made via our website. 

    7. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same payment method, and/or orders that use the same billing or shipping address. We reserve the right to limit or prohibit orders that appear to be placed by dealers, resellers, or distributors.

  10. Liability 

    1. You may have additional rights under applicable consumer laws (for example, if you are located in New Zealand, the Consumer Guarantees Act 1993 and Fair Trading Act 1986 or in Australia the Australian Consumer Law 2010) in relation to any products purchased from our website. Your consumer rights under any applicable consumer laws are in addition to these Terms, and nothing in these Terms is intended to have the effect of limiting or reducing your consumer rights. 

    2. Other than under applicable consumer laws and to the maximum extent permissible by law, your sole remedy for any loss or damage arising in connection with our products, the website, or a breach by us of these Terms, is as expressly set out in these Terms. 

    3. We are not liable to you or any other person for any consequential, special, punitive, incidental, indirect or economic loss or damage, or loss of profits or opportunity arising from your use of our website, purchase of product(s), or otherwise in connection with these Terms. 

    4. Despite any other provision in these Terms and to the maximum extent permissible by law, if we are determined liable to you for any loss or damage, such liability is limited, in aggregate, to the amount paid by you for the product giving rise to liability.

  11. Intellectual property 

    1. HEIREST (and its licensors) own all intellectual property rights in and relating to our website. Nothing in these Terms transfers any such intellectual property rights. You must not attempt to assert any ownership or rights in any such intellectual property rights. 

  12. General 

    1. These Terms are governed by the laws of New Zealand.  The parties submit to the non-exclusive jurisdiction of the courts of New Zealand in respect of any matter arising out of or in connection with these Terms. 

    2. Nothing in these Terms shall create or be deemed to create any rights in any person or entity not a party to these Terms. 

    3. If any part of these Terms is held to be invalid, illegal or unenforceable (in whole or in part) it will be severed and the remainder of these Terms will, to the extent possible, remain in full force and effect. 

    4. Any delay or failure to enforce our rights under these Terms shall not relieve you from compliance with such obligations and does not mean we have waived those rights. 

    5. We will not be liable for any failure or delay in complying with any of our obligations to you if such failure or delay results from a cause beyond our control. Nothing in this clause will excuse a party from any obligation to make payment when due under these Terms.
