  1. Definitions 

    1. In this Policy, the following terms have the following meanings: 

      1. “Applicable Privacy Laws” means the Australian Privacy Act 1988 and the New Zealand Privacy Act 2020. 

      2. “HEIREST”, “we”, “us”, “our” means HEIREST Limited.

      3. “Personal Information” means information about an identifiable individual. 

      4. “Policy” means this Privacy Policy.  

      5. “You” and “your” means the person using our website and purchasing products from us. 

  2. About this Policy

    1. HEIREST respects your privacy rights and is committed to ensuring that we protect these privacy rights. This Policy sets out how we will collect, use, disclose and protect Personal Information collected in relation to products accessed and sold through our website.

    2. When dealing with Personal Information, we will comply with this Policy and with Applicable Privacy Laws.  If you are situated outside of Australia or New Zealand, this Policy might not comply with the privacy regulations in your location. If you live elsewhere in the world and access or purchase products from our website, you do so at your own risk, knowing that you are providing us with Personal Information, which we will deal with as if you were subject to the Australian Privacy Act 1988 and/or the New Zealand Privacy Act 2020.

    3. This Policy does not limit or exclude any rights you may have under applicable privacy laws in the countries in which our website is available. 

    4. By using our website, purchasing products, creating an account, corresponding with us, or otherwise by providing your Personal Information to us, you acknowledge the collection and use of such information by us, in accordance with this Policy.

    5. This Policy should be read in conjunction with our Terms and Conditions, which you can access here. 

    6. From time to time, we may change or update this Policy by posting an updated version on our website. Your continued use of our website after any such change or update constitutes acceptance by you of that change or update. The amended Policy shall apply from the date that it is uploaded to our website. 

  3. Collection of Personal Information 

    1. We may collect Personal Information from you, when you:

      1. use our website, including when you submit any form through our website; 

      2. order product(s) through our website; 

      3. subscribe to our mailing list; 

      4. create a customer account with us; 

      5. interact with us, including interacting with any social media accounts we operate, or by responding to email marketing; and 

      6. make a customer service enquiry. 

    2. The Personal Information we may collect includes (but is not limited to): 

      1. your name and contact information, including your email address, phone number and physical address; 

      2. if you are an account holder, details of designs that you have created and stored, your previous order history, and any other details that we require for you to hold an account with us; 

      3. details required to fulfill any order you place, for example, your ring size; 

      4. payment details (although we do not store full payment details); 

      5. information that you provide to us in the course of your interaction and/or engagement with us; and 

      6. any other relevant information that we may require. 

    3. Browsing data is tracked using cookies. Cookies are small data files that are sent to your device from our website. Cookies do not collect identifiable information about you but will identify your device.

    4. Your browser settings can be changed to disable cookies, which can be done on a per-site basis. However, this may mean that you cannot use all of the features on our website, or other websites.

  4. Use of Personal Information 

    1. We will not use or disclose your Personal Information except in accordance with this Policy and Applicable Privacy Laws. The Personal Information we hold about you will only be used for purposes directly related to our activities, and when it is necessary for or directly related to these activities.

    2. We may use the Personal Information that we collect generally to: 

      1. create, process, and fulfil any orders placed through our website; 

      2. correspond and communicate with you about orders, products, marketing, special offers, and promotional campaigns; 

      3. provide you with invoices and/or order confirmations; 

      4. improve our products, website, and online shop; 

      5. respond to any requests, feedback, inquiries, or concerns; 

      6. undertake email marketing; 

      7. for statistical and analytical purposes; 

      8. carry out our general business functions and activities; 

      9. protect and/or enforce our legal rights and interests, including defending any claim; and  

      10. comply with Applicable Privacy Laws and other applicable privacy laws and regulations, and for any other purpose authorised by you, or by Applicable Privacy Laws.

    3. If there are additional purposes (other than those outlined above) for which we propose to use your Personal Information, we will notify you of the purpose(s) and your consent will be requested to the proposed use.

    4. We will always give you the option to decline to provide your Personal Information or to decline to allow us to use that Personal Information for the purposes for which we have proposed to use it and will comply so long as doing so does not prevent us from meeting our legal obligations under Applicable Privacy Laws. 

    5. If you decline to provide your Personal Information, this might affect your use of our website, receiving products from us, us communicating with you, or us carrying out our general business activities. 

  5. Disclosure of Personal Information 

    1. We do not sell, rent, or exchange Personal Information to any third party. 

    2. We may disclose Personal Information to third parties for the purposes outlined above at paragraph 4.2, and for directly related purposes (including those required under Applicable Privacy Laws). 

    3. Some of the third parties that we may disclose Personal Information to may include (but are not limited to):

      1. third party manufacturers, service providers, suppliers, or contractors who we do ordinary business with (including payment systems operators, providers of commercial management software, and providers of customer service software);

      2. e-commerce and website hosting service providers;

      3. third party freight and logistics providers (including courier companies);

      4. email marketing, service and analytics providers; and 

      5. other selected providers and vendors authorised by us to carry out our business activities. 

  6. Storage, security and retention of Personal Information 

    1. We take the security of your Personal Information seriously and ensure that we comply with our legal obligations to protect your Personal Information.

    2. Your Personal information is held and stored by Shopify and Airtable. We recommend that you review these third parties’ privacy policies, which you can locate here and here. 

    3. We will only retain Personal Information for as long as it is required for the purpose(s) for which it may lawfully be used. Once Personal Information is no longer required, we will securely destroy it or otherwise delete all identifying details so that only anonymised data is retained. 

    4. If you are an account holder who deletes your account with us, we will subsequently delete any Personal Information associated with your account.

  7. Accuracy, accessing, and correcting Personal Information 

    1. We take all reasonable steps to ensure that your Personal Information that we hold is accurate, up to date, complete, relevant and not misleading.

    2. You have the right to request access to your Personal Information held by us or ask for it to be corrected if you think it is wrong.

    3. If you are an account holder, you can directly update some of your Personal Information by logging into your account. When placing orders, if you do not type an answer to a required form correctly, we may contact you through the contact details provided to confirm whether the information provided is correct.

    4. If you would like to request access to your Personal Information, or ask to have it corrected, please contact us at support@HEIREST.com. 

  8. Notifiable Privacy Breaches

    1. If your Personal Information is involved in a privacy breach which we reasonably believe is notifiable or must be reported in accordance with Applicable Privacy Laws (“Notifiable Privacy Breach”), we will report the Notifiable Privacy Breach to the relevant supervisory authority and inform the affected individual(s) in accordance with Applicable Privacy Laws.

    1. If you wish to make a complaint in relation to your handling of your Personal Information by us, please contact us at support@HEIREST.com. You may also contact the New Zealand Office of the Privacy Commissioner or the Office of the Australian Information Commissioner if you are unsatisfied with how we have handled your Personal Information, or your complaint.
